LEGAL1. Acceptance of Terms
By accessing or using SpeakMore ("the App"), you accept and agree to be bound by these Terms of Service. If you do not agree, do not use the App. These Terms apply to the SpeakMore mobile app, web app, and related services operated by Erstdev.
2. Description of Service
SpeakMore is a community-powered language learning platform. Users can learn languages through short lessons, contribute educational content such as translations and voice recordings, participate in ranked challenges, and earn experience points through participation.
SpeakMore is a practice tool. It does not replace qualified teachers, immersion, or conversation with proficient speakers.
3. Account
To use most SpeakMore features, you must create an account. You are responsible for:
- Maintaining the security of your account credentials.
- All activities that occur under your account.
- Complying with these Terms while using the service.
You must provide accurate information and keep your account details up to date where applicable.
4. User Conduct
You agree not to:
- Submit content that is offensive, harmful, harassing, hateful, or violates applicable laws.
- Attempt to manipulate voting, rewards, rankings, or other participation systems.
- Impersonate others or provide false information.
- Use the App for any illegal or unauthorized purpose.
- Interfere with or disrupt the App's functionality, security, or other users' experience.
We may investigate violations and take action, including content removal, feature restrictions, or account termination.
5. Content and Intellectual Property
Users retain ownership of content they contribute. By submitting content to SpeakMore, you grant Erstdev a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, display, distribute, and adapt your content within the App and related services for educational and community purposes.
The App's design, code, branding, and curated lesson materials are protected by intellectual property laws and remain the property of Erstdev and SpeakMore, except for user-contributed content licensed as described above.
6. Rewards and Points
SpeakMore may distribute rewards such as experience points (XP) or coins for participation. We reserve the right to modify reward structures, balances, or eligibility rules at any time to maintain fairness and service integrity.
Points and in-app rewards have no guaranteed monetary value and should not be treated as an investment or cash equivalent unless explicitly stated otherwise in a separate offer.
7. Ambassador and Subscriptions
SpeakMore may offer paid subscriptions such as Ambassador through Google Play Billing or Apple In-App Purchase. Subscription terms, pricing, renewal, and cancellation are governed by the applicable app store and the purchase flow presented at the time of purchase.
Subscriptions renew automatically unless cancelled through your platform account before the renewal date. Deleting your SpeakMore account does not automatically cancel an active subscription. Manage billing through Google Play Subscriptions or Apple App Store Subscriptions.
8. Privacy
We collect and use personal data as described in our Privacy Policy. By using SpeakMore, you acknowledge that you have read and understood that policy.
9. Disclaimers
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee that:
- The App will be error-free or uninterrupted.
- Content accuracy or quality meets your expectations.
- Any particular learning outcome will be achieved.
10. Limitation of Liability
To the fullest extent permitted by law, Erstdev and SpeakMore shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the App, including but not limited to loss of profits, data, or account access.
11. Third-Party Services
The App may integrate with third-party services such as app store billing, subscription validation, analytics, or authentication providers. We are not responsible for the functionality, security, or policies of those third-party services.
12. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes become effective when posted on this page with an updated date. Continued use of the App after changes constitutes acceptance of the modified Terms.
13. Termination
We may suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or the service. You may delete your account at any time through in-app Settings or our account deletion page.
14. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict-of-law provisions.
